A collective/class action lawsuit has been filed on behalf of Customer Service Representatives (CSRs) working for a leading chemical and ingredient distributor. The lawsuit was filed in the United States District Court for the Northern District of Georgia, Atlanta Division.  The defendants, Univar Inc. and Univar USA Inc. (UUI), are publicly traded companies incorporated in Wilmington, Delaware with customer service facilities located in Georgia and numerous other locations throughout the country. Univar provides more chemical products and related services than any other company in the marketplace.

The plaintiffs are employed as Customer Service Representatives by Univar.  Their job duties included, among other things, the troubleshooting of customer inquiries regarding issues they face during the course of their business with UUI. Additionally, the CSRs were required to perform order entry, order fulfillment and shipping arrangements.  The Customer Service Representatives claim, among other things, that Univar formulated a nationwide “comp time” policy they knew violated Federal and State Labor laws by failing to properly compensate CSRs for their weekly overtime, which was sometimes in excess of 60 hours weekly.
